International Union of Non-Governmental Organizations “World Peoples Assembly” for its websites and the mobile application
1. General provisions
1.1. This User Agreement (hereinafter referred to as the “Agreement”) specifies the terms of use of the websites and the mobile application of the International Union of Non-Governmental Organizations “World Peoples Assembly” (hereinafter referred to as the “Operator, the Assembly”) and governs the relations between the Operator and the User.
1.2. The Agreement applies to the following resources of the Operator (hereinafter referred to as the “Website, the Websites”):
1.2.1. the website of the Assembly is https://world-assembly.org;
1.2.2. the website of the World Public Summit is https://worldpublicsummit.org;
1.2.3. the website “Leader of Public Diplomacy” is https://public-diplomacy.org;
1.2.4. the mobile application of the Assembly (hereinafter referred to as the “Application”), distributed through the App Store and Google Play.
1.3. Any use of the Website and the Application, including viewing pages, registration, submission of applications and use of the Services, constitutes the User’s full and unconditional acceptance of the terms of the Agreement.
1.4. If the User does not agree with the terms of the Agreement, the User shall cease using the Website and the Application.
1.5. The Operator recommends that the User review the text of the Agreement upon each visit to the Website: the Agreement may be amended in the manner provided prescribed by Section 11.
2. Terms and definitions
2.1. The terms used in the Agreement have the meanings established by the Operator’s Policy on the processing and protection of personal data on the Operator’s websites and in the Operator’s mobile application (hereinafter referred to as the “Policy”), unless otherwise defined in this Section.
2.2. User is any person visiting the Website and using the information, materials and Services of the Website. The User of the Website is a personal data subject within the meaning of Federal Law No. 152-FZ of 27 July 2006 “On Personal Data”.
2.3. Website Services mean interactive (dialogue) software components on the Website pages that provide the User with certain capabilities to access information and perform actions, including registration, management of a personal account, submission of applications for participation in events, payment of fees, and sending of inquiries.
2.4. Personal Account is a section of the Website to which the User obtains access upon registration and which contains information about the User, the applications submitted and the payments made.
2.5. Credentials mean the email address and password used by the User to access the Personal Account.
2.6. User Materials mean texts, images, photographs, documents and other objects posted or transmitted by the User on the Website.
3. Registration and Personal Account
3.1. Certain Services of the Website are available only to registered Users.
3.2. Upon registration, the User provides accurate information about himself or herself and keeps it up to date. The Operator is entitled to require the timely updating of the information provided.
3.3. The User is solely responsible for maintaining the confidentiality of the Credentials and for all actions performed in the Personal Account using them.
3.4. The User shall immediately notify the Operator of any unauthorised access to the Personal Account at the address specified in Section 12.
3.5. Registration as a representative of a legal entity means that the natural person acting on its behalf holds the necessary authority.
3.6. The Operator is entitled to refuse registration or to restrict access to the Personal Account where the User breaches the terms of the Agreement or provides inaccurate information.
4. User’s Rights and obligations
4.1. The User is entitled to:
4.1.1. use the Website and the Application for personal, non-commercial purposes in accordance with their intended purpose;
4.1.2. access the Services of the Website to the extent provided for the relevant category of Users;
4.1.3. submit enquiries to the Operator, including on matters relating to the processing of personal data, in the manner specified in the Policy.
4.2. The User undertakes to:
4.2.1. provide accurate information and not to impersonate another person;
4.2.2. refrain from posting materials that violate the legislation of the Russian Federation or the rights of third parties, including the right to one’s own image, honour, dignity and business reputation;
4.2.3. refrain from actions that disrupt the operation of the Website and the Application, including attempts to gain access to other Users’ Personal Accounts and the use of automated means of collecting information without the Operator’s written consent;
4.2.4. respect the proprietary and non-proprietary intellectual property rights of the Operator and of third parties.
4.3. By posting User Materials, the User confirms that he or she holds the necessary rights to them and, where the materials contain the image of an individual, that the consent of such individual provided for by Article 152.1 of the Civil Code of the Russian Federation has been obtained.
4.4. Unacceptable content and conduct. The Assembly brings together people from different countries, with different views, faiths and languages. Dialogue here is possible only on the basis of mutual respect, and we therefore maintain zero tolerance for abusive content and for participants who behave abusively. Such content is deleted, and the offender loses access.
In messages, discussions, profiles, titles, photographs and any uploaded materials, it is prohibited to post:
- insults, humiliation, bullying and harassment of other participants;
- threats, incitement to violence and statements inciting hatred on national, racial, religious, linguistic, gender or any other grounds;
- indecent and pornographic materials, as well as materials depicting cruelty;
- calls to unlawful acts, promotion of drugs, weapons and extremist ideas;
- deception, fraudulent offers and financial pyramid schemes;
- advertising and the distribution of repetitive messages unrelated to the matter at hand;
- other persons’ personal data published without that person’s consent;
- impersonation of another person or organisation.
How to report. Next to every message, publication and profile there is a “Report” command with a choice of reason (spam, insult, fraud, prohibited content, other). A report may also be sent via email to info@world-assembly.org. We review every report and delete unacceptable content within 24 hours after the report submission, and we inform the reporting party of the decision taken.
How to protect yourself from unwanted contacts. In private correspondence a correspondent may be blocked — after that their messages will no longer be delivered. The block may be withdrawn at any time.
Consequences for the offender. Depending on the severity and recurrance of the violation, the Operator deletes inappropriate content, restricts access to correspondence and discussions, blocks the account. In case of a gross or repeated violation, The Operator deletes the account along with the right to participate in the events of the Assembly. Decisions on complaints and measures are taken by the Organizing Committee of the Assembly. If a measure has been applied in error, write to info@world-assembly.org — we will investigate the matter and recover access.
5. Rights and obligations of the Operator
5.1. The Operator is entitled to:
5.1.1. change the content, composition and operating procedures of the Website, the Application and the Services without prior notice to the User;
5.1.2. suspend the operation of the Website and the Application in order to carry out technical work;
5.1.3. delete User Materials that violate the terms of the Agreement or the legislation of the Russian Federation;
5.1.4. restrict or terminate the User’s access to the Services where the User breaches the terms of the Agreement.
5.2. The Operator undertakes to:
5.2.1. process the User’s personal data in accordance with the Policy and the requirements of Federal Law No. 152-FZ of 27 July 2006 “On Personal Data”;
5.2.2. consider the User’s enquiries within the time limits established by the legislation of the Russian Federation.
6. Personal data
6.1. The processing of the User’s personal data is carried out by the Operator in accordance with the Policy, which is freely available on the Website.
6.2. By accepting the terms of the Agreement, the User confirms that he or she has reviewed the Policy.
6.3. Consent to the processing of personal data, consent to receive informational messages and consent to the publication and further use of an individual’s image are executed as separate documents and are not replaced by acceptance of this Agreement.
7. Participation in events and payment of fees
7.1. An application for participation in an event of the Operator is submitted through the relevant Service of the Website.
7.2. The application is reviewed by the Operator; the outcome of the review is sent to the User at the email address specified by the User.
7.3. The conditions of participation and the amount and procedure for payment of fees are determined by the Operator and published on the Website.
7.4. The Operator is not a payment settlement provider and does not store the User's payment card data: settlements are processed through engaged third-party payment services under the terms and conditions established by them.
8. Intellectual property
8.1. The Website, the Application, their design elements, software, texts, images and other materials are objects of the Operator’s intellectual property or are used by the Operator on a lawful basis.
8.2. The use of materials from the Website is permitted provided that the source is acknowledged and an active hyperlink to the Website, unless otherwise established by the legislation of the Russian Federation or agreed with the Operator in writing.
8.3. By posting User Materials, the User grants the Operator a royalty-free right to use them for purposes connected with the activities of the Assembly worldwide, for the term of the exclusive right.
9. Liability of the parties
9.1. The Website and the Application are provided on an “as is” basis. The Operator does not warrant uninterrupted or error-free operation of the Website and the Application.
9.2. The Operator is not liable for the content of third-party websites to which links are placed on the Website.
9.3. The User is solely liable for the content of the Materials posted by the User and for the consequences of the use of the Credentials by third parties.
9.4. The Operator’s liability for breach of the requirements of Federal Law No. 152-FZ of 27 July 2006 “On Personal Data” arises in accordance with the legislation of the Russian Federation.
10. Settlement of disputes
10.1. Any disputes and/or disagreements arising out of the relations between the User and the Operator shall be resolved in accordance with the applicable legislation of the Russian Federation.
10.2. A pre-trial claim procedure is mandatory prior to recourse to the courts: the claim shall be submitted in writing, and the period for a response is thirty calendar days from the date of its receipt.
10.3. The applicable legislation of the Russian Federation applies to the Agreement and to the relations between the User and the Operator.
11. Final provisions
11.1. The Operator is entitled to amend the Agreement without the User’s consent.
11.2. A new edition of the Agreement enters into force upon its publication on the Website, unless the new edition provides otherwise. The new edition applies to relations arising after it enters into force.
11.3. The invalidity of individual provisions of the Agreement does not entail the invalidity of its remaining provisions.
